By accessing or using KillSEO ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. By using our Service, you represent that you are at least 18 years of age and have the legal capacity to enter into binding agreements.

KillSEO provides AI-powered SEO analysis tools including but not limited to:

• Website SEO audits and health checks • Answer Engine Optimization (AEO) analysis • Competitor analysis and intelligence • AI-generated recommendations and fix suggestions • Sitemap and technical SEO analysis

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without prior notice. We are not liable for any modification, suspension, or discontinuation of the Service.

As a user of KillSEO, you agree to:

• Provide accurate and complete information when creating an account • Maintain the security of your account credentials • Not share your account with unauthorized parties • Use the Service only for lawful purposes • Not attempt to reverse engineer or decompile any part of the Service • Not use automated systems to access the Service beyond intended API limits • Not analyze websites without proper authorization where required • Comply with all applicable local, state, national, and international laws

The following activities are strictly prohibited:

• Using the Service to harm, harass, or defame others • Attempting to gain unauthorized access to our systems or other users' accounts • Using the Service to distribute malware, spam, or malicious content • Reselling or redistributing analysis results without authorization • Using the Service to violate intellectual property rights • Conducting denial of service attacks or overwhelming our infrastructure • Scraping or data mining our Service beyond normal usage patterns • Using the Service to engage in any form of fraud or illegal activity

Violation of these prohibitions may result in immediate account termination without refund.

KillSEO operates on a pay-per-analysis credit model:

PAYMENT TERMS: • All payments are processed securely through Stripe • Prices are listed in USD and include all applicable taxes • Payment is required before analysis credits are issued • Credits are non-transferable between accounts

REFUND POLICY: • If an analysis fails due to a system error on our end, you will receive a full credit refund or free retry • Refunds are not provided for analyses that complete successfully, even if results are not as expected • Refund requests must be submitted within 7 days of the failed analysis • Refunds are processed within 5-10 business days

CREDIT EXPIRATION: • Purchased credits do not expire • Credits cannot be exchanged for cash value

OWNERSHIP: The Service and its original content, features, and functionality are owned by KillSEO and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

YOUR CONTENT: You retain ownership of any data you input into the Service. By using the Service, you grant us a limited license to process this data solely for the purpose of providing the requested analysis.

ANALYSIS RESULTS: Analysis reports generated for your account are licensed to you for your personal or business use. You may share reports with colleagues or clients but may not resell or redistribute them commercially.

FEEDBACK: Any feedback, suggestions, or ideas you provide about the Service become our property and may be used without compensation or attribution.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE DO NOT WARRANT THAT: • The Service will be uninterrupted or error-free • Analysis results will be completely accurate or comprehensive • Following recommendations will guarantee improved search rankings • The Service will meet all of your specific requirements

LIMITATION OF LIABILITY: In no event shall KillSEO, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of the Service.

Our total liability shall not exceed the amount you paid for the specific analysis that gave rise to the claim.

TERMINATION BY YOU: You may terminate your account at any time by contacting support or using the account deletion feature. Upon termination, your access to the Service will cease immediately.

TERMINATION BY US: We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms.

EFFECTS OF TERMINATION: • All provisions of the Terms which by their nature should survive termination shall survive • Unused credits are forfeited upon account termination for cause • We may retain certain data as required by law or for legitimate business purposes • You may request deletion of personal data in accordance with our Privacy Policy

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

Current version of these Terms will always be available on this page with the last updated date clearly indicated.

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
